Article 1. Definitions

    2. customer: the company that has entered into an agreement with Qooqie;
    3. service: the call tracking service that Qooqie provides to the customer in the context of the agreement;
    4. Agreement: the agreement between Qooqie and the Customer;
    5. website: the website www.qooqie.com operated by Qooqie;
    6. Data: all data that Qooqie processes in the context of the provision of the service and on behalf of the customer.

Article 2. Data and controller

  1. For Qooqie, careful handling of data is of great importance. With regard to the processing of data, Qooqie acts in accordance with the applicable laws and regulations. Processing of data on behalf of the customer takes place in accordance with Article 12 of the general terms and conditions of Qooqie. Before the customer can enter into an agreement with Qooqie, the customer must agree to the general terms and conditions of Qooqie.
  2. The customer is the controller of the data.

Article 3. Purposes of the processing

  1. Qooqie collects and processes the customer's data, such as company name, address, e-mail address, Chamber of Commerce number, name of contact person, bank account number and telephone number, for the following purposes:
    1. handling a question and/or comment from the customer;
    2. the conclusion of the agreement;
    3. providing the service;
    4. the automatic collection of the fee for the service;
    5. maintaining a customer relationship with the customer;
    6. to be able to contact the customer in connection with the execution of the agreement;
    7. complying with administrative obligations;
    8. to keep the customer informed of news about Qooqie and about the service.

Article 4. Sending digital newsletters

  1. If the customer has given his prior express consent, newsletters will be sent by Qooqie to the e-mail address provided by the customer. These newsletters contain information about the services provided by Qooqie.

Article 5. Unsubscribing from newsletters

  1. The customer can unsubscribe from the newsletters at any time.
  2. You can unsubscribe from newsletters in the following ways:
    1. by sending an e-mail to Qooqie requesting that his e-mail address be removed from Qooqie's mailing list;
    2. by clicking on the link in the e-mail containing the newsletter that allows the customer to unsubscribe from such newsletters.
  3. In every newsletter sent to the customer, the customer is informed of the possibility to unsubscribe from the newsletters.
  4. If the customer has unsubscribed from the newsletters, Qooqie will remove the customer's email address from his mailing list as soon as possible.

Article 6. Disclosure of data to third parties

  1. Qooqie will not provide the customer's data to third parties, unless one of the exceptions mentioned in article 6.2 applies.
  2. Qooqie is allowed to provide the customer's data to a third party:
    1. if the customer has given his or her express consent;
    2. in the context of a legal provision or legal proceedings;
    3. to protect the rights or property of Qooqie;
    4. for the prevention of a crime or for the protection of state security;
    5. in case of suspicion of fraud or other illegal activities;
    6. it is necessary for the provision of the service or the execution of the agreement.
  3. Qooqie may use other companies to execute parts of the agreement, such as a reseller. These engaged companies need access to certain customer data to perform their tasks. Qooqie obliges these third parties to treat the customer's data confidentially.

Article 7. Correcting data

  1. Upon request, Qooqie will grant the customer access to all information that Qooqie holds about him. Furthermore, Qooqie offers the customer the opportunity to have any incorrect data that Qooqie keeps about him corrected or deleted. For access to said information or to change or delete the customer's data, the customer can contact Qooqie.

Article 8. Security

  1. In order to prevent unauthorized access to the customer's data and the data, Qooqie has taken various security measures, including measures against unauthorized access, use, modification, unlawful and unintentional destruction and unintentional loss of the customer's data and the data.
  2. Data provided to Qooqie via the website is stored via a secure web environment.

Article 9. Third-Party Privacy Policy
